Court allows accused to appear for the Open Book Examinations (OBEs)

A 22-year-old student of Delhi University (DU) has been allowed, by a Delhi court to take the Open Book Examinations (OBEs). The decision came on Thursday, the 13th of August, 2020. The student is one of the seven accused of the murder of a man along with causing riots in north-east Delhi in February.

Aman Kashyap is currently pursuing B.A. from the School of Open Learning (SOL), DU. He had filed a plea through his counsel advocate, Rajeev Kumar Tiwari and his advocate, Vimal Tiwari for interim bail to appear for the exam. They stated that Kashyap had been falsely accused of the crimes that he did not commit. After his plea was filed, the court had asked the superintendent of the Mandoli jail to submit a detailed report.

The superintendent had confirmed that Kashyap had an exam scheduled on August 14. It was then that Vinod Yadav, the additional sessions Judge allowed him to appear for the exam. The superintendent said that all necessary arrangements shall be made to facilitate his Open Book Examinations.

On the 25th of June, the crime branch had filed a charge sheet in the Delhi court regarding the murder of a 22-year-old Monis. He was a daily wage earner who had been ambushed and beaten to death by a mob on the Brijpuri Road on the 25th of February. The mob had also set fire to several private and public properties. Seven persons, including Kashyap, were arrested and charged for arson, rioting, murder, and criminal conspiracy.

On the 1st of April, Kashyap was arrested. However, his counsel Tiwari, stated that a planted witness had falsely testified against him. According to the counsel, Shashi Kant who allegedly saw the incident from his home (located quite a distance away) was lying because nothing beyond 800 meters is visible as the road is also curved. He also stated that a discharge application would be filed in the court soon.
